Please read these Terms of Service ("Terms") carefully before using the TipCryp platform, widget, or API ("Service"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About TipCryp

TipCryp is a decentralised crypto tipping infrastructure product operated by TipCryp AG, a company incorporated in Zug, Switzerland. The Service provides an embeddable widget that enables creators to receive cryptocurrency tips directly to their own wallets from their audience.

TipCryp acts solely as a technology provider. We are not a payment processor, financial institution, or money services business. We do not hold, custody, or transmit funds at any point. All transactions occur peer-to-peer directly on public blockchain networks.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service you represent that you are of legal age and have the legal capacity to enter into a binding agreement.

3. API Key Licence

Upon successful payment or verification of $TCM token holdings, TipCryp grants you a non-exclusive, non-transferable, revocable licence to use the TipCryp widget and API key for the purpose of receiving crypto tips on your own platforms and websites.

• Creator Pass licences are valid for one (1) year from the date of issue.
• $TCM holder access is valid for as long as the verified wallet holds a minimum of 2,500 $TCM tokens.
• API keys may not be shared, sold, transferred, or used on behalf of third parties.
• TipCryp reserves the right to revoke any API key at any time for violation of these Terms.

4. Payment & No Refund Policy

All payments for Creator Pass licences are made in cryptocurrency. By making a payment you acknowledge and agree to the following:

• All cryptocurrency transactions are irreversible by their nature. TipCryp does not have the ability to reverse, refund, or recall any on-chain transaction once broadcast.
• All sales are final. No refunds will be issued under any circumstances.
• It is your responsibility to ensure you are sending the correct token and amount to the correct address before confirming any transaction.
• Network gas fees are paid by the sender and are non-recoverable.

5. Acceptable Use

You agree not to use the Service to:

• Facilitate illegal activity, fraud, money laundering, or the financing of terrorism.
• Deceive or mislead your audience about the nature of the tipping widget.
• Reverse engineer, decompile, or attempt to extract the source code of the TipCryp widget beyond what is publicly available.
• Resell, sublicence, or redistribute the widget or API key to third parties.
• Use the Service in any way that could damage, disable, or impair TipCryp's infrastructure or reputation.

6. Cryptocurrency Risk Disclosure

Cryptocurrency markets are volatile. The value of any digital asset may fluctuate significantly. TipCryp makes no representations regarding the value of any cryptocurrency. You accept all risk associated with receiving, holding, or transacting in cryptocurrency.

7. No Financial Advice

Nothing on the TipCryp platform constitutes financial, investment, legal, or tax advice. You should seek independent professional advice before making any financial decisions.

8. Intellectual Property

All content, code, branding, and materials on the TipCryp platform are the property of TipCryp AG and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without prior written consent.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. TipCryp does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by applicable law, TipCryp AG and its officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of funds, loss of data, or loss of profits.

10. Indemnification

You agree to indemnify and hold harmless TipCryp AG and its affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service or your breach of these Terms.

11. Modifications to the Service

TipCryp reserves the right to modify, suspend, or discontinue the Service at any time with or without notice. TipCryp shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Changes to These Terms

We may update these Terms from time to time. We will indicate the effective date at the top of this page. Continued use of the Service after any changes constitutes acceptance of the revised Terms.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Canton of Zug, Switzerland.
